Intellectual Property

Intellectual property comprises a body of legal rights connected with creation, innovation, and the distinctive signs of businesses, products, and services. As markets have developed and reliance on intangible assets has increased, these rights have become part of the commercial value of many companies, ventures, and individuals. This practice addresses the legal aspects connected with the protection, the management, and the exploitation of intellectual property rights, including trademarks, copyright and the rights related to it, and the other rights that the law confers upon their owners. These aspects arise at different points in the life of a business, alongside the decisions and the transactions that may affect the ownership of a right, the extent of its use, and the manner in which it is protected. On that basis, intellectual property work is connected with a number of matters that appear at different stages of the business cycle, whether at the point at which a right comes into existence, during its use in the market, or upon its transfer to others.

Intangible Assets

The value of many businesses is no longer tied to physical assets alone; trademarks, content, creative works, and other intellectual rights have come to form part of the commercial identity and the economic value of an enterprise. The protection of these rights is therefore bound up with the management of the assets that distinguish an activity and give it its particular character within the market. The effects of intellectual property may extend to a number of aspects concerning the use of rights, their exploitation, their disposal, or their protection against infringement and against unauthorised use. For that reason, the treatment of these rights extends beyond the moment of registration to their use, their exploitation, and their defence throughout the life of the business.
